Green Light for Devakathikoppa Industrial Area against Paltry Penalty, ₹2.34 Cr Remediation Plan

The recent evaluation of projects pertaining to Infrastructure Development, Ship Breaking Yards, including Ship Breaking Units 7(b), Industrial Estates/ Parks/ Complexes/ Areas, and Export Processing Zones transpired during a two-day meeting held from the 9th to the 10th of November 2023.
The proposal for the development of the Devakathikoppa Industrial Area by the Karnataka Industrial Areas Development Board, spanning 459.24 Acres near Devakathikoppa and Siddalipura Villages in Shivamogga Taluk, Shivamogga District, was subjected to environmental clearance (EC) under the violation category. The Ministry of Environment, Forest and Climate Change issued Terms of Reference (ToR) on August 23, 2022. The project is currently in violation, with 60% of constructions completed without obtaining prior EC, as per the EIA Notification, 2006. The landscape for projects facing violations has undergone a significant shift, with a notable reassurance for developers. While the specter of violations persists, the government of India's implementation of the "polluter pay" concept has altered the narrative. Now, instead of just fearing regulatory repercussions, projects found in violation are required to allocate additional funds as per this principle. Consequently, a total amount of Rs. 2,34,50,000/- is allocated for the Remediation Plan and Natural Resource and Community Resource Augmentation Plan, with an additional penalty of Rs. 77.14 Lakhs under the violation case.
